The 2011 legislative sessions in both Sacramento and Washington,
D.C. have yielded significant developments for labor and
employment law. Some of the new laws have created new
duties for employers and may expose employers to liability for
older claims. Additionally, there are bills still pending
that show important policy-making trends in labor and employment
law. Overall, the national employment law trends reflect
the political changes in Washington, including the increase in
legislative influence of labor unions.

A recent study of giving levels by Blackbaud Index of Charitable
Giving heralded a 1.4 percent increase in charitable giving,
which brought it even with pre-recession levels. We winced when
we saw the headline “Fundraising Returns to Pre-Recession Levels”
and could just imagine executives and boards all over the country
asking themselves, “What are we doing wrong?

Surely we all want to grow philanthropy, and the total dollars do
grow, except during a recession. So that’s good. But, for 40
years, U.S. charitable giving has stayed fairly constant—at about
two percent of average household income according to the Center
on Philanthropy at Indiana University’s annual “Giving USA”
report on philanthropy. That’s just not so good. Actually, that’s
pretty bad. Now is the time to face this problem. But let’s think
of this as an opportunity—the opportunity to grow philanthropy in
the U.S.
